Buyer understands and agrees that the cat or kitten, hereafter called “Kitten” described above is being purchased as an indoor pet and is sold with NO breeding rights. Kitten can be shown under select show/alter categories.

PAYMENT

The Buyer may pay online via our website at www.murdermittenskittens.com or in person. We accept cash as well as all major credit and debit cards.

We do not accept Zelle or Venmo payments due to the high rate of scam activity associated with these payment methods for our security as well as the security of our customers.

HEALTH GUARANTEE, REFUNDS, REPLACEMENT

Breeder represents and warrants, to the best of their knowledge and belief and based upon genetic testing performed on the Kitten’s parents, that the Kitten is HCM negative and SMA Negative. However, if, within the first twelve (12) months of the Kitten’s life, it is determined through an examination by a licensed veterinarian (if the Kitten is ill) or thorough necropsy (if the Kitten has died), that such illness or death is the direct result of its having one or more of these two (2) genetic conditions, Buyer shall notify Breeder and provide a copy of the written medical examination or necropsy. Failure to permit and provide a necropsy will void and null the warranty. Buyer may request a replacement kitten of equal value in the same manner set forth in the 12 Month Genetic Guarantee below.

Buyer agrees to inform Breeder immediately if Kitten dies of any cause that is suspected to be of a genetic nature or hereditary nature. It is imperative that Breeder be made aware of any potentially heritable conditions in order to make decisions regarding continued breeding or spay/neuter of certain studs and queens.

Allergies to cats/kittens and behavioral issues such as litter training are not cause for refund or replacement.

7 DAY GUARANTEE

Breeder guarantees a healthy Kitten upon delivery or pick-up and for seven (7) calendar days thereafter. If during the seven (7) days your Kitten is found to have any issues that cannot be resolved by medication, Breeder will refund the purchase price of the kitten, less any delivery fees. To receive this refund the Buyer must inform the Breeder of the issues via email to rebeccadavis35@hotmail.com within 48 hours of discovery, return the Kitten to the Breeder and provide written proof of the examination from a licensed veterinarian. Failure to report within the 48 hours after discovery will void the guarantee.

*Please note - for heart murmur diagnosis we require two (2) different veterinary confirmations. Please read our information on Maine Coon Breed Health Information provided after this contract to further explain this requirement.

12 MONTH GENETIC GUARANTEE

If at anytime within the first 12 months of the Kittens life it is found to be unsound in health due to any genetic condition that will cause a reduction in lifespan or quality of life of the Kitten, the Kitten shall be returned to the Breeder and the Buyer may request a replacement with another Cat/Kitten of equal value. Said replacement will be made as soon as a suitable replacement becomes available. A medical report or necropsy signed by the examining veterinarian must be provided to the Breeder prior to replacement being made. There shall be no replacement unless the conditions of this contract are followed.

VETERINARY CARE

It is the Buyer’s responsibility to provide immediate veterinary care, at the Buyer's expense, if the Kitten shows signs of illness or distress and as preventative routine care. Failure to do so will void any guarantees. The Buyer assumes responsibility for all expenses incurred in relation to the Kitten once in the Buyers possession. Buyer understands this Kitten has been kept in a optimum environment for socialization and development, and agrees to follow recommendations provided at the time of transfer.

We do not vaccinate against Feline Leukemia (FeLv) or Feline Infectious Peritonitis (FIP). These are not CORE vaccines. Buyer agrees that they will not use rabies vaccines containing Thimerosal. Any of these without consulting the Breeder first will null and void all guarantees. Breeder also agrees that it will request no Ketamine to be used as an anesthetic on this Kitten. Please request the use of Gas anesthetic as an alternative.

Buyer will not have the Kitten declawed or de-vocalized.

HOME CARE

Breeder recommends that the Buyer make arrangements for the Kitten should something happen to the Buyer. We will accept that due to forces out of Buyers control that there may come a time that the Kitten cannot remain with the Buyer or with the person the Buyer has made arrangements with. If such a time arrives, we will gladly accept the Kitten back to our cattery with “no questions asked” and at no cost. This is to ensure our Kittens do not end up in animal shelters. This is, however, not cause for refund or replacement.

Buyer agrees to place the Kitten in quarantine/isolation from other pets for a minimum of seven (7) days when unsupervised. The Kitten should be provided with plenty of attention and not left alone for extended periods of time until the adjustment to their new environment has been made. The buyer should be aware that Kittens often during times of stress will exhibit signs of illness such as sneezing, runny nose, watery eyes, diarrhea, or constipation. These effects can be minimized by feeding identical food as served by the Breeder, offering bottled water or filtered water and by taking steps to reduce stress when introducing the Kitten to the Buyer’s home, children, and other pets. These health symptoms are usually temporary and should go away within the first few days if the Kitten is not further stressed. However, use your best judgment and take your Kitten to the Veterinarian if you feel it is warranted.

Buyer accepts all responsibility and risk associated with the purchase of a live animal. Kittens are not to be resold. Kitten will not be sent to a shelter, pet shop, research laboratory or other such facility. Kitten will receive adequate health care, dental care, and dietary care. Kitten will be provided a litter box that is cleaned daily.

PEDIGREE AND ALTERING

Kitten is purchased as a pet and will be spayed or neutered.

Breeder will provide a digital copy of the Kitten’s pedigree but it will be redacted of pertinent information until such a time as the Buyer provides proof of spay/neuter in the form of veterinary records. This statement should include:

DELIVERY OF YOUR KITTEN

We do not ship kittens via air travel. It is very stressful for the kittens and can be quite expensive. We will deliver with our kitten nanny for $1.25 per mile anywhere in the Northeast United States up to 500 miles from 10923 Country Haven Drive, Lakeland Florida 33809. If the Kitten is couriered by our kitten nanny, all cost will be paid by the Buyer. The Kitten will only be released by the courier after full payment for the Kitten has been made. Specific arrangements will be determined in advance and confirmed with the Kitten’s best welfare in mind. A signed contract must be returned prior to shipping. Shipping cost will be due upon transfer of the Kitten. If payment for shipping costs is not available when the Kitten is to be transferred, the Buyer forfeits all costs paid and the Kitten will not be released to the Buyer.

DAMAGES AND JURISDICTION

Breeder’s total liability is limited to the purchase price of the Kitten as stated above. Although there are not plans to discontinue the breeding program, the above health warranties are only valid if the Breeder is breeding cats. All other portions of the contract will remain valid. All differences of opinion between the parties shall remain confidential. No negative information will be transmitted by either the Buyer or the Breeder. Buyers’ failure to honor the conditions of the contract will result in ownership of the Kitten being reverted to the Breeder with no compensation to the Buyer. It is agreed that any legal action taken to enforce the terms of this Contract to be in small claims court in Polk County Florida and will be governed by Florida State Law.
